1. Introduction

These Terms of Service ("Terms") govern your use of the GlutenScan mobile application ("App") operated by Delpha Labs ("we", "us", "our"). By downloading, installing, or using the App, you agree to be bound by these Terms.

If you do not agree to these Terms, do not use the App.

2. Service Description

GlutenScan is an AI-powered gluten detection app. You can take or upload a photo of an ingredient label, and our service will analyze the ingredients to determine whether the product is likely safe, unsafe, or uncertain for people with celiac disease or gluten sensitivity. Results are generated by artificial intelligence and are provided for informational purposes only.

3. Medical Disclaimer

GlutenScan is not a medical device. The information provided by the App is for informational and educational purposes only. It is not intended to be a substitute for professional medical advice, diagnosis, or treatment.

You should not rely solely on GlutenScan to determine whether a product is safe for consumption. AI-generated results may contain errors. Always read ingredient labels yourself and consult your doctor or dietitian for medical decisions related to celiac disease or gluten intolerance.

By using the App, you acknowledge and accept that we are not liable for any adverse health effects resulting from reliance on the App's analysis.

4. Accounts

To use GlutenScan, you may need to sign in with an account. You are responsible for maintaining the security of your account and for all activity that occurs under it. You must be at least 13 years old to use the App.

5. Subscriptions and Billing

Free Tier

All users receive a limited number of free scans per month at no cost.

Pro Subscription

GlutenScan Pro is available as a monthly auto-renewing subscription. Pro subscribers receive unlimited scans and additional features.

Billing

All payments are processed through the Google Play Store or Apple App Store. By subscribing, you agree to the respective store's payment terms. We do not directly collect or store your payment information.

Cancellation

You may cancel your subscription at any time through your Google Play or Apple App Store account settings. Cancellation takes effect at the end of the current billing period. No partial refunds are provided for unused time within a billing period.

Refunds

Refund requests are handled by the Google Play Store or Apple App Store according to their respective refund policies.

6. AI-Generated Results

Gluten detection results, ingredient analysis, and safety verdicts are generated by artificial intelligence. While we strive for accuracy, we make no guarantees that results are correct, complete, or up to date. Specifically:

  • Results may be incorrect. AI may misread ingredients, miss hidden gluten sources, or produce false positives/negatives.
  • Product formulations change. Manufacturers may change ingredients without notice. A scan of an older label may not reflect the current product formulation.
  • Cross-contamination cannot be fully assessed from a label. Manufacturing processes, shared equipment, and supply chain factors are not always disclosed on labels.
  • Results do not constitute medical advice, diagnosis, or treatment.

You acknowledge that AI-generated results are for informational purposes only and you use them at your own risk and discretion.

7. Acceptable Use

You agree not to:

  • Use the App for any unlawful purpose
  • Attempt to circumvent scan quotas or other usage limits
  • Reverse engineer, decompile, or disassemble the App
  • Use automated tools, bots, or scripts to interact with the App
  • Upload content that is illegal, harmful, or infringes on the rights of others
  • Resell or redistribute the App's analysis results as a commercial service without our written permission

8. Intellectual Property

The App, including its design, code, AI models, and content, is owned by Delpha Labs and protected by applicable intellectual property laws. Your scan results belong to you, and you may use them freely.

9. Privacy

Your use of the App is also governed by our Privacy Policy, which describes how we collect, use, and protect your data.

10. Disclaimer of Warranties

The App is provided "as is" and "as available" without warranties of any kind, whether express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the App will be uninterrupted, error-free, or free of harmful components.

We specifically disclaim any warranty that the gluten detection results are accurate, complete, or suitable for any particular health or dietary purpose.

11. Limitation of Liability

To the fullest extent permitted by applicable law, Delpha Labs shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, arising from:

  • Your use of or inability to use the App
  • Any errors or inaccuracies in AI-generated results
  • Decisions made based on information provided by the App, including dietary or health decisions
  • Adverse health effects resulting from reliance on the App's analysis
  • Unauthorized access to your account or data

Our total liability for any claim arising from these Terms or the App shall not exceed the amount you paid us in the 12 months preceding the claim.

12. Account Deletion

You may delete your account and all associated data at any time through the App's settings or by contacting us at delphalabs@gmail.com. Upon deletion, all your scans and account information are permanently removed from our servers.

13. Termination

We reserve the right to suspend or terminate your access to the App at any time, with or without cause, including for violation of these Terms. Upon termination, your right to use the App ceases immediately.

14. Changes to These Terms

We may update these Terms from time to time. We will notify you of material changes by updating the "Last updated" date at the top of this page. Your continued use of the App after changes constitutes acceptance of the updated Terms.

15. Governing Law

These Terms are governed by and construed in accordance with the laws of France, without regard to conflict of law principles. Any disputes arising from these Terms shall be subject to the exclusive jurisdiction of the French courts.
